Search Lane County Probate Records
You can search for Lane County probate court records through the Lane County records portal. The system lets you look up cases by case number, party name, date range, case type, or document type. Online searches are the fastest way to find basic case information. For copies of actual documents, you will need to submit a public records request.
State law allows the court to charge fees to recover actual costs for locating and providing public records. Normal and reasonable staff time is 10 minutes or less per request. If your request will cost more than $25, the court gives you an estimate first. They will not proceed until you confirm in writing and send payment in advance. Once the work is done, the court refunds any excess over actual costs.
Copy fees are $0.25 per page. A double-sided copy counts as two pages. Certified copies cost $5.00 per certificate plus the per-page fee. These rates apply to all Lane County probate court records.
Lane County Probate Legal Resources
The Lane County Law Library is located in the basement of the Lane County Public Service Building at 125 East 8th Avenue. It sits across from Jury Assembly, and you do not need to pass through court security to reach it. The library is open from 8:00 am to 5:00 pm on weekdays.
The library offers four public computers with internet access. These computers have icons for three legal databases: Westlaw, HeinOnline, and BarBooks. Lane County Estate Proceedings
Estate cases in Lane County follow Oregon probate law. Under ORS 111.055, the Circuit Court has jurisdiction over the estate of any person who was domiciled in Lane County at the time of death. The process begins with filing a petition for probate. The court then appoints a personal representative and issues letters giving them authority to act.
The personal representative must inventory all assets, notify creditors, pay valid debts, and distribute the remaining estate. Annual and final accountings are filed with the court. All of these documents become part of the Lane County probate court records. Guardianship and conservatorship cases follow a similar pattern, with court oversight of the fiduciary's actions.
Oregon also allows a Small Estate Affidavit under ORS 114.515 for estates that fall below the statutory limits. This is a simpler path that avoids a full probate proceeding in Lane County. The affidavit cannot be filed until 30 days after the date of death.
